1. Acceptance of Terms

By accessing or using NovoSend ("Service"), operated by NovoSend ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Description of Service

NovoSend provides a branded file sharing platform that allows users to upload, send, and share files with customizable branding. The Service includes free and paid subscription tiers with varying storage limits, file size limits, and features.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, share, or distribute illegal, harmful, or infringing content
  • Distribute malware, viruses, or any other harmful software
  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service for spam or unsolicited communications
  • Circumvent any usage limits or restrictions of your subscription tier

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Intellectual Property

You retain all rights to the content you upload. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service. All NovoSend branding, logos, and software are our intellectual property.

6. Subscription and Payments

Paid subscriptions are billed on a recurring basis through Stripe. You may cancel at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods.

7. File Storage and Retention

Files are stored according to the retention policy of your subscription tier. Expired transfers and their associated files may be automatically deleted. We are not responsible for data loss due to expired transfers or account termination.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits arising from your use of the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of significant changes via email or through the Service.

11. Termination

We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
